This privacy policy describes how Dwellists Inc. ("Dwellists," "Earnest IQ," "we," "us," or "our") collects, uses, and shares information when you use the Earnest IQ website and the Earnest IQ real estate platform (the "service"). By using the service, you agree to the practices described here.
If you use the service in a state with its own privacy law, additional rights may apply to you. Those are set out in sections 12 and 13.
Earnest IQ is a technology platform, built by Dwellists Inc., that helps property owners sell their property. The platform supports two paths:
This policy covers both paths and everything on the Earnest IQ marketing site.
Dwellists Inc. is not a real estate brokerage and does not represent you in the sale of your property. Where a step requires a licensed professional — brokerage, title, escrow, appraisal, inspection, or legal services — that service is provided by an independent licensed third party under its own agreement with you, and that third party's own privacy policy governs the information you give it directly.
Account details. Your name and email address collected through our authentication provider when you create an account or sign in.
Property information. The address, characteristics, condition, and asking price of the property you're selling, and information about your ownership of it.
Conversation content. What you type or say to the Earnest IQ assistant, including answers about your property, your selling goals and timeline, and any disclosures you make.
Voice recordings. If you turn on voice mode, your spoken audio is captured and transcribed. See section 4.
Documents. Files you upload or generate through the platform, such as disclosure statements, inspection reports, title documents, offers, and financing paperwork. These may contain information about people other than you, including buyers and their agents.
Payment information. If you purchase a paid step of the service, your payment details are collected and processed directly by our third-party payment processor. Dwellists does not receive or store your full card number.
Communications. Messages you send us, such as support requests, beta feedback, and survey responses.
Usage data. Pages visited, features used, time spent, actions taken in the assistant, and similar analytics.
Device and technical data. IP address, browser and device type, operating system, approximate location derived from IP address, and server log data, used for security, fraud prevention, and troubleshooting.
Cookies and similar technologies. See section 3.
From brokers and service providers. If you're matched with a broker or another provider through the service, we may receive updates on the status of your transaction, including whether a sale closed.
From public and licensed sources. Publicly available property records, tax records, and listing data used to prefill and verify property details.
We and our providers use cookies, local storage, and similar technologies to keep you signed in, remember your preferences, measure how the service is used, and secure the service against abuse.
Strictly necessary. Required for the service to work — authentication, session security, and load balancing. These can't be turned off.
Analytics. Help us understand which features are used and where people get stuck.
Preference. Remember settings such as whether voice mode is on.
You can control cookies through your browser settings; blocking strictly necessary cookies will prevent parts of the service from working. We honor the Global Privacy Control (GPC) signal as a valid opt-out request where required by law.
The Earnest IQ conversation is generated by an AI assistant. Unless we tell you otherwise, you are interacting with an AI system, not a human representative. The assistant provides general guidance and organizes your transaction. It does not provide legal, tax, or brokerage advice, and its output can be incomplete or wrong. Decisions about your sale are yours.
Your messages are sent to our AI provider to generate a response, and are stored by us as part of your conversation history so the assistant can pick up where you left off.
If you turn on voice mode, your audio is sent to a third-party speech-to-text provider to produce a transcript. Where the assistant replies by voice, a text-to-speech provider generates the audio you hear. We keep the transcript as part of your conversation history and do not retain raw audio beyond what is needed to produce the transcript.
By turning on voice mode you consent to this recording and transcription. Several states require all parties to a recorded conversation to consent. If another person is present and may be captured, do not use voice mode without their consent.
We use the information described above to:
We won't send you marketing email without your consent, and you can opt out of non-essential communications at any time using the unsubscribe link or by contacting us.
We share information in the following situations, and no others:
Service providers. Companies that host our infrastructure, run authentication, power the AI conversation, process speech and voice, process payments, send email and text messages, and provide analytics. Each acts on our behalf under contract and may use your information only to provide its service to us.
Brokers you're matched with. If you choose the broker path, we share your name, contact details, property information, and the context needed for the broker to serve you. Once you engage a broker, that broker is an independent business and handles your information under its own privacy policy.
Other licensed professionals and affiliated providers. Title and escrow companies, inspectors, appraisers, contractors, and financing partners, when a step of your sale requires their involvement and you've asked us to connect you.
Legal and safety. Where required by law, subpoena, or legal process, or to protect the rights, property, or safety of Dwellists, our users, or others.
Business transfers. In a merger, acquisition, financing, or sale of assets, where your information may be transferred as part of the transaction. We'll notify you before your information becomes subject to a different privacy policy.
We do not sell your personal information. We do not share it with third parties for cross-context behavioral advertising or for their own independent marketing purposes.
We want you to understand how Earnest IQ makes money, because it affects how you should read our recommendations.
Sell on your own. You pay Earnest IQ a platform fee and a closing fee, disclosed to you before you commit.
Sell with a broker. You pay Earnest IQ nothing. If you engage a broker we matched you with and your property sells, that broker pays Earnest IQ a referral fee out of its commission. The broker's commission is negotiated between you and the broker, and the referral fee does not increase what you pay.
Other providers. We may receive compensation from some title, escrow, financing, or contractor partners we connect you with.
Where a referral is compensated, we'll tell you at the point of referral, not just here. You are never required to use a provider we suggest, and you can choose any provider you like.
We keep information only as long as we need it. Our general schedule:
Account and profile. For as long as your account is active, then 60 months after you close it.
Conversation history and transcripts. 60 months from the date of the conversation, or until you delete it, whichever comes first.
Raw voice audio. Deleted once the transcript is produced.
Transaction documents and closing records. 5 years after closing, to meet real estate and tax record-keeping requirements.
Payment records. 5 years, as required by tax and financial regulations.
Usage and log data. 60 months.
You can ask us to delete your information at any time. We'll honor the request except where we're required by law to keep certain records, and we'll tell you if that's the case.
We use reasonable technical and organizational safeguards to protect your information, including encryption in transit, encryption at rest for stored documents, access controls limiting who on our team can see your data, and monitoring for unauthorized access.
No method of transmission or storage is completely secure, and we can't guarantee absolute security. If a breach affects your information, we'll notify you as required by law.

We'll verify your identity before acting, usually by confirming control of the email address on your account, and we may ask for additional information for requests involving transaction documents. We respond within 45 days and may extend once by another 45 days where the request is complex, in which case we'll tell you.
You can designate someone to make a request on your behalf. We'll ask for written permission signed by you, and we may still ask you to verify your own identity directly.
If we decline your request, you can appeal by replying to our decision or writing to privacy@dwellists.com with "Privacy appeal" in the subject line. We'll respond within 45 days with our decision and the reasons for it. If we deny the appeal, we'll give you a link to submit a complaint to your state attorney general.
This section applies to California residents and supplements the sections above.
In the last 12 months we've collected the following categories of personal information, each from you directly, from your device automatically, or from brokers, service providers, and public records as described in section 2. We disclose each category to service providers, and to brokers and licensed professionals where a step of your sale requires it, for the business purposes listed in section 5.

We have not sold personal information or shared it for cross-context behavioral advertising in the last 12 months, and we do not knowingly do so for anyone under 16.
Some of what you tell the assistant may qualify as sensitive personal information. We use it only to provide the service you asked for and for the purposes permitted under California law, and we don't use it to infer characteristics about you.
If you live in Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, or another state with a comprehensive privacy law, you have the rights listed in section 10, and you may exercise them the same way. We don't process personal information for targeted advertising, sale, or profiling that produces legal or similarly significant effects, so no opt-out is needed for those activities.
If you live in Nevada, you may tell us not to sell your covered information. We don't sell it.
Earnest IQ is for adults who can enter a binding contract to sell property. It isn't directed at children, and we don't knowingly collect information from anyone under 18. If you believe a minor has given us information, contact us and we'll delete it.
Dwellists is based in the United States, and our team and service providers may be located outside the state or country where you live, including in Canada and the United States. By using the service, you understand your information may be processed in those locations under this policy.
We may update this policy as the service evolves. We'll post the updated version here with a new "last updated" date. For material changes, we'll give you additional notice by email or in the product before the change takes effect.
